LINE PLAY Terms of Service
This LINE PLAY Terms of Service ("ToS") sets forth the terms and conditions for LINE PLAY (“Service”) between You of the Service (“You”) and LINE Corporation ("LINE").
The following terms have the meanings set forth below when they are used in the ToS.
1.1. "Content" means information such as text, audio files, music, images, videos, software, programs, computer code, and the like, that may be accessed through the Service.
1.2. "In-App Currency" means a virtual currency, which You may use to pay for the Paid Service.
1.3. "Paid Service" means services including but not limited to the digital Contents offered to You in the Service, which is not free of charge.
1.4. "Submitted Content" means content that You have submitted, transmitted, or uploaded.
1.5. "Avatar" means a graphical character image that represents you in the Service.
2. Agreement to ToS
2.1. You have to use the Service in accordance with the terms and conditions stated in the ToS. You must not use the Service unless You agree to the ToS. Such agreement is valid and irrevocable.
2.2. If there are documents released or uploaded by LINE that pertain to the Service, under the title "agreement," "guideline," "policy," and the like, You also have to comply with such documents as well as the ToS.
3. Modification of ToS
LINE may modify the ToS when LINE deems necessary. You shall be deemed to have granted valid and irrevocable consent to the modified ToS by continuing to use the Service.
4.1. You, when providing information about yourself to LINE, shall provide genuine, accurate, and complete information while using the Service, and keep such information up-to-date at all times.
4.2. If You register a password while using the Service, You must exercise due care and responsibility in order for the password not to be used in an unlawful manner. LINE may treat all activities conducted through Your account as activities that have been conducted by You.
4.3. When You change your communication devices by which You use the Service, You may not continue to use on your new communication device the data of In-App Currencies, Submitted Contents, or the like, in cases where You are using the Service without connecting your LINE account or other SNS account.
4.4. LINE reserves the right to delete any user account that has been inactive for a period of a year or more since its last activation, without any prior notice.
4.5. Your rights to use the Service will expire when your account has been deleted for any reason.
4.6. Each user account in the Service is for the exclusive use and belongs solely to the owner of the account. You may not transfer or lend your account to anybody nor may your accounts be inherited by anybody.
5.1. LINE places their highest priority on Your privacy.
5.3. LINE promises to exercise the utmost care and attention regarding its security measures for the continued security of any and all Your Information.
6. Provision of the Service
6.1. You have to supply the necessary PC, mobile phone device, communication device, operating system, and data connection necessary for using the Service under Your own responsibility and at Your own expense.
6.2. LINE reserves the right to limit access to the whole or part of the Service depending on conditions that LINE considers necessary, such as age, identification, current membership status, and the like.
6.3. LINE reserves the right to modify or cease, at LINE’s own discretion, the whole or part of the Service at anytime without any prior notice.
7. Business Partners' Services
Contents or other services offered by other business partners cooperating with LINE may be included within the Service. The business partners bear all responsibility regarding such Contents and/or services offered. Furthermore, such Contents and services may be governed by the explicit ToS etc., which are set accordingly by the business partners.
8.1. LINE grants You the non-transferable, non-re-licensable, non-exclusive license to use the Contents provided by LINE, only for the purpose of using the Service. Notwithstanding situations where phrases such as "Purchase", "Sales," and the like appear on the Service screens, titles/ownerships of all intellectual property rights as well as all other rights in the Contents will never be transferred to You, but only the aforementioned license to use the Contents will be granted to You.
8.2. You cannot use the Contents beyond the scope of the intended use of the Contents in the Service (including but not limited to copying, transmission, reproduction, modification).
8.3. If You wish to back-up the whole or part of the Submitted Contents, you will need to do so yourselves. LINE will not undertake the obligation of backing up any of the Submitted Contents.
8.4. The Service may include functions where multiple users may post, correct, edit, and delete items. In such cases, You have to allow other users to perform any editing in relation to Your Submitted Contents.
8.5. You maintain the rights regarding Your Submitted Contents just as before, and LINE will not acquire any rights to such Submitted Contents. However, if such Submitted Contents are visible, not just to the Your "friends" but to all the other users, You grant LINE a worldwide, non-exclusive, royalty-free license (with the right to sublicense such content to other third parties working together with LINE), for an indefinite period, to use (after modifying such content, if LINE believes it necessary and proper) such content for services and/or promotional purposes.
8.6. LINE may check the details of the Submitted Contents, when LINE believes that the Submitted Contents may violate related laws or provisions set out in the ToS. However, LINE is not obligated to conduct such investigations.
9. In-App Currencies
9.1. In-App Currencies will be provided to You by the means specified by LINE such as purchases, special offers, and the like. Details regarding the payment methods, units, terms and all other conditions regarding In-App Currencies will be decided by LINE and displayed accordingly on the Service.
9.2. In-App Currencies cannot be exchanged or used for any other purposes other than the ones offered by the Service. The number of In-App Currencies required for receiving the offered services or contents, and terms and condition of In-App Currencies will be decided by LINE and displayed accordingly on the Service.
9.3. In-App Currencies once purchased by You cannot be refunded for any reason. However, this does not apply if required by applicable laws. If this occurs, LINE will process refunds of In-App Currencies in accordance with the relevant laws, and such information will be made available on LINE’s website etc.
9.4. In-App Currencies can be used only in the account in which You purchased the In-App Currencies, and cannot be assigned or transferred to other accounts. Furthermore, In-App Currencies cannot be carried over or combined between communication devices running on different operating systems such as iOS, Android, and the like, as the types of In-App Currencies differ even though they are categorized under the same name.
10. Deletion of the Avatar
10.1. You can delete the Avatar in the Service. In the event you delete the Avatar, all of Your rights in the Service, including the right to use the Content and the right to use In-App Currencies expires and cannot be restored.
10.2. When you uninstall the application of Service, all of Your rights in the Service, including the right to use the Content and the right to use In-App Currencies expires and cannot be restored in cases where You are using the Service without connecting your LINE account or other SNS account.
You must not engage in the following when using the Service.
11.1. Activities that violate the law, court verdicts, resolutions or orders, or administrative measures that are legally binding.
11.2. Activities that may hinder public order or customs.
11.3. Activities that infringe intellectual property rights, such as copyrights, trademarks and patents, fame, privacy, and all other rights of LINE and/or a third party granted by the law or contract.
11.4. Activities that post or transmit excessively violent or sexual expressions; expressions that lead to discrimination by race, national origin, creed, sex, social status, family origin, etc.; expressions that induce or encourage suicide, self-injury behavior, or drug abuse; or anti-social expressions that include anti-social content and lead to the discomfort of others.
11.5. Activities that lead to the misrepresentation of LINE and/or a third party, or intentionally spread false information.
11.6. Activities such as sending same or similar messages indiscriminately to numerous users, or any other activities deemed to be spamming by LINE.
11.7. Activities that exchange the right to use the Service including but not limited to the Contents, In-App Currencies into cash, property or other economic benefits without LINE’s authorization.
11.8. Activities that use the Service for sales, marketing, advertisement, soliciting or other commercial purposes; use the Service for the purpose of sexual conducts or obscene acts; use the Service for the purpose of meeting a person for sexual encounters; use the Service for the purpose of harassments or libelous attacks against other users; or use the Service for purposes other than the Service's true intent.
11.9. Activities that benefit or collaborate with anti-social groups.
11.10. Activities that are related to religious activities or invitations to certain religious groups.
11.11. Activities that illegally or improperly lead to the collection, disclosure, or provision of other's personal information, registered information, user history, or the like.
11.12. Activities that interfere with the servers and/or network systems of the Service; that abuse the Service by means of BOTs, cheat tools, or other technical measures; that deliberately use defects of the Service; that access to the Service through the communication devices to which an alteration has been made by looting, jail breaking, or the like, that make unreasonable inquires and/or undue claims such as repeatedly asking the same question beyond the necessity, and that interfere with LINE's operation of the Service or other users’ use of the Service.
11.13. Activities that aid or encourage any activity stated in Clauses 11.1 to 11.12 above.
11.14. Other activities that are deemed by LINE to be inappropriate.
12. Your Responsibility
12.1. You have to use this Service at your own risk, and will bear all responsibility for actions carried out and their results upon this Service.
12.2. LINE may take the following measures without any prior notice, if LINE acknowledges that You are using the Service in a way which violates the ToS:
12.2.1. Withdrawal or deletion of whole or part of the Submitted Contents;
12.2.2. Suspension or revocation of the Your right to use the Contents;
12.2.3. Suspension of use of whole or part of the Services;
12.2.4. Suspension or deletion of your account; or
12.2.5. Any other measures that LINE considers necessary and appropriate.
12.3. In the case where LINE has suffered loss/damage or has been charged an expense (including but not limited to lawyer's fees) directly or indirectly (including but not limited to cases where LINE has been sued for damages by a third party) due to Your violation of applicable laws or the ToS while using the Service, You have to immediately compensate LINE upon its request.
13. LINE’s Exemption of Liability
13.1. LINE does not expressly or impliedly guarantee that the Service (including the Contents) are free from de facto or legal flaws (including but not limited to stability, reliability, accuracy, integrity, effectiveness, fitness for a particular purpose, security-related faults, errors, bugs, or infringements of rights). LINE is not responsible for providing the Service without such defects.
13.2. LINE is not responsible for any damages inflicted on You in relation to Your use of the Service. However, this does not apply if required by applicable laws. If this occurs, the compensation for ordinary damages in respect to LINE’s contractual default or act of tort due to LINE’s negligence will be limited to the total amount of received fees from You in the particular calendar month in which such damages occurred.
14. Notification and Contact
14.1. When LINE notifies or contacts You regarding the Service, LINE may use a method that LINE considers appropriate, such as posting on the website operated by LINE.
14.2. When You notify or contact LINE in regard to the Service, You will use the customer inquiry form available on LINE’s website or other means designated by LINE.
15. Governing Law and Jurisdiction
This ToS is governed by the laws of Japan. Conflicts that arise from the Service or conflicts between You and LINE related to the Service will be governed primarily under the exclusive jurisdiction of Tokyo District Court.
16. For Children Under 13 and in the U.S
If You are under 13 years of age and in the U.S. (“Children”), LINE collect your ID, password and your parent email address. LINE does not collect any further information from Children in the Service. The parent email address is used only for account administration purpose. Children are not able to chat in the Service or post any Content. Children are not able to share or access social media in the Service. Children will not receive push notifications. There is no advertising for Children in the Service. In app purchasing is available.
